I-PREAMBLE -1- Τhe present leaflet concerns therelations between the “Tiamo resort Only Ltd which is engaged in trade andinteractions with the name (as a kind of distinctive title) TIAMO RESORT,Leading Villas, as a hotel management company-provider of services and any personwho might request rental of the tourist accommodation owned or managed by WPHDand who becomes the recipient of its services; the present applies to alltourist accommodation properties of Tiazmo resorts, independently from theirlocation, on the South Andros Island in The Bahamas -2- Thewebsite “www.tiamoresorts.com” allows placing an order of rental of the touristaccommodation owned or managed by theTiamo Resorts Company, as well as of any servicesdirectly provided by Tiamo resorts or by its associates. The most usualprocedure for a rental order of tourist accommodation owned, managed or ingeneral operated by the Tiamo resort Company is carried out through theDivision for Reservations and Sales of the Company or/and through otherassociates of the Company, tourist agents or not, under the form of request,offer, verification of the reservation and so on. The present leaflet isapplicable to all means of rental and in general in all the reservations-salesof the Company. In case that the services are provided by thirdparties-associates of WHPD, the order for those services is directly madebetween the Client and the Associate and is subject to the pricing policies ofthat Associate. It is specified that the services which may be provided bythird parties-associates of Tiamo Resorts do not constitute in the general partof a fixed combination/package of many touristic services which is offered at asingle price. -3- Everyrental order of accommodation or services on the Tiamo Resort website orthrough other available means or/and services means the full and withoutreservations acceptance of the present Regulation, as well as of the invoicingand pricing terms applicable to all the tourist residences and the services,for which the order has been placed -4- Therespective electronic order is transmitted to Tiamo Resort through its websiteor with any other means (for example through the Reservations and Sales Division)only provided that the Client has been informed of the present Regulation andthe respective necessary information and he/she declares having been informedof the latter and his/her full understanding and irrevocable acceptance throughthe respective available choice or through any other means available. No orderfor a rental or for any other services is valid nor is to be transmitted toTiamo Resorts unless the aforementioned condition is met. -5- TheClient may save and print the present Regulation and any other informationcontained on Tiamo Resorts’s website as mentioned above, in order to study thisinformation carefully and fully and become totally aware of the latter. -6- Τhe website of Tiamo Resort and anyother available services (offer, request, any document of the company relatingto a reservation and a rental order, the rental contract, where applicable,undersigned etc.) may mainly comprise the following information (indicativereference):* Thestatutory objectives of the Tiamo resort, its legal entity, the address of itsregistered seat or of its branch in The Bahamas, the telephone number of theCompany’s registered seat or of its branch in Bahamas, the e-mail address, itsregistry information in the General Commercial Registry for Companies, its VATinformation and the declaration that the stay in its accommodation fullycomplies with the services stipulated by the Bahamas Ministry of Tourism. * The basic characteristics of the touristaccommodation that Tiamo resorts rents, as well as the comforts and servicesassociated with the accommodation (i.e. the basic services). The descriptiveinformation on each tourist property of the company Tiamo resort or under themanagement of the latter can be read and studied in the context of the rentalorder. * Theadditional services that may be available, and it needs to be specified thatwhere such services are provided by third parties and Tiamo Resorts’sassociates and not by Tiamo Resorts directly, depend in terms of theirprovision exclusively on those associates of Tiamo Resorts ; Tiamo Resorts doesnot guarantee their availability, they are provided and invoiced exclusively byTiamo Resorts’s associates and do not constitute part of a combination of moretourist services offered at a single total price. * the otherprovisions and services which are available to the Client, such as,indicatively, the potential possibility to use items offered by Tiamo Resortsat a special price. * The costof a stay, as set out in the form of the invoice * the meansof payment * theadvance payment amount * theduration of the offer and of the fixed price
-II-DEFINITIONS For thepurposes of the present regulation the terms set out below are meant anddefined with the following meaning: “Order forrent/services” means the client’s request for rental of the touristaccommodation of Tiamo and for the provision of the services on behalf of TiamoResorts. ”Confirmation of reception” means an e-mail message sent by the Tiamo Resortswebsite or by any other available service to the customer regarding theconfirmation of receipt of the Client’s order, if this order was made throughthe website or by any other available services (and not by other means, such asby telephone or telegram). “Requestfor order confirmation” means an intangible or tangible document thatrecapitulates the characteristics of the stay and other services that theClient has ordered, which document is sent on the same day of the receipt ofthe order. The specific document may request, inter alia, the details, and thenumber of the Client’s bank card in the context of the advance payment. “Confirmationor non-confirmation of booking” means an intangible or tangible document sentto the client, depending on the case, electronically, in writing or bytelegram, after receipt of the rental/service order, which either confirms thepayment of the deposit and/or constitutes the written acceptance of the order,in such a way that the completion of the order is realized, or thenon-acceptance of the customer’s order is stated. “Advancepayment/pre-payment” mean an amount of money no more than 25% of the total ofthe agreed price for the overnight stays of the arranged days of stay and noless than the rental cost of one day, which is due to be paid to Tiamo beforethe stay, with the exception of special terms and agreements, where the latterapply following an explicit special agreement with the Client, most frequentlyon the grounds of an advantageous price or package on offer. The payment of theadvance payment constitutes in any case the completion of the order of theClient, unless it is explicitly stated otherwise that his/her bookingconfirmation constitutes acceptance of the booking made, even if the latter isnot explicitly stated in the “confirmation of booking”. Tiamo Resorts holds thediscretionary power to request the advance payment at a time later than the“confirmation of order” on its behalf. «Bookingprocedure» means the whole procedure between the stages of “order rental/services”and the “confirmation of booking” placed by the Client. “Client”means every person acting for his/her personal or professional needs. «Consumer»means every person who satisfies the requirements of Law of The Bahamas. “E-mail”means any message in the form of text, voice, sound or image sent by a publiccommunication network and stored on a network server or within the recipient’sterminal equipment until it is received by the latter. “Associates”means providers of services accessible from the Tiamo Resorts’s website or fromother services or on the spot, in particular, who may especially be touroperators, car, ship or aircraft leasing companies, ticket issuers of ticketsfor flights, trains, spectacles, museums, professional recreational activitiessuch as water sports, diving, fishing or various excursions. “Provisionof hotel service” means the lease on behalf of Tiamo Resorts of a tourist lodging under its property or management or of a part of such a lodging, themain characteristics of which are presented on the Tiamo Resorts website, or onthe advertising brochures and its catalogs, plus the extras offered by Tiamo asrelevant services. “Website”means an electronic service managed by Tiamo Resorts online and which isavailable on the address www.tiamoresorts.com . “Generalterms of stay” means the stipulations and provisions laid down in the presentRegulation and the relevant provisions of law, as applicable.
-III- OBJECT -1- Τhe present regulation lays down therights and obligations of the parties in the context of leasing by TiamoResorts of tourist accommodation under its property or management, either itsgeneral utilization or part of such tourist accommodation, through its websiteor through other services, and the provision by the company of the associatedhotel services. -2- Theterms shall describe all the necessary steps concerning the order, booking, andservices after the reservation between the Tiamo Resorts and the client. -3- Theclient acknowledges the fact of being informed and accepts the presentRegulation, as well as the terms of sale and the other services of the TiamoResorts by an invoice that is accessible on the website. -4- In theevent that the Company and the client have agreed with another document orcontract between them, in part or in whole, special terms, these terms prevailover the present Regulation, always in the context where they are more specificor different than those present.
-IV- SCOPE This regulationis applicable to all bookings made through the internet, the website, and otherservices and Departments of Tiamo Resorts.
-V-DURATION -1- ThisRegulation is applicable as long as it remains published on the website or aslong as it is annexed to other Tiamo Resorts’ relevant services. -2- TiamoResorts reserves the right, without prior notice, to temporarily or permanentlydiscontinue the access to its website and/or its online services provided.
-VI- CLIENT ORDER -1- Theclient shall choose solely among the tourist accommodation under rent and anyother services provided by Tiamo Resorts and the other services offered. -2- Theclient acknowledges the fact of being informed of the nature, purpose, and waysof booking accommodation and any available services on the website or otherservices of Tiamo Resorts, as well as that he/she has looked through andobtained any useful or necessary information or/ and every additionalinformation in order to carry out and complete his/her order, in full andabsolute knowledge of the purpose of the latter. -3- Theclient shall place his/her order to the competent Booking Department of thecompany and particularly through the electronic mail address:reservations@tiamoresorts.com as well asthrough the company’s website: www.tiamoresorts.com -4- Theclient shall bear full responsibility for the choice of accommodation, as wellas the optional or complementary services and the adequacy of the latter as tohis/her wishes and needs, in a way that he/she does not seek any liability fromTiamo Resorts concerning this issue. -5- Theorder is considered to be complete upon completion of the booking process.
-VII-BOOKING PROCESS -1- Ordersby the Client are made by submitting a request of reservation through anypossible and available means; via a written message of electronic mail, anintangible form, within the company’s website or otherwise. -2- Anorder is considered complete when the total amount or the set advance paymentof the rental is prepaid in accordance with the agreed rental or theconfirmation of booking by Tiamo Resorts. -3- Theclient is bound from the beginning by each order individually. The client isobliged to fill in all the necessary information including his/her bank cardinformation. -4- Theclient verifies the integrity and the accuracy of the information that he/shesubmits. -5- Theprocess of reservation usually includes the following stages: *Stage 1:research/search of tourist accommodation and options of services and a price/ofan invoice *Stage2: selection, in case that it isdesirable, of a range of additional or optional services. *Stage 3:submission of request – order *Stage 4:confirmation of specifications of the order, its total cost, of applicablepurchase terms and final application of selection (tourist accommodation orpart of the property, cost, additional or optional services). *Stage 5:providing the necessary personal information of the client – signature of thecontract of a rental order. *Stage 6:provision of the client’s bank card information – advance payment and/orpartial payment – of the cost of the booking. *Stage 7:confirmation of booking by Tiamo Resorts, in accordance with the special termsand conditions agreed by the Client.
-VIII-CONFIRMATION OF RECEPTION ORDER -1- Thiswebsite and the relevant services of Tiamo Resorts confirm the reception of theorder with an instant message of electronic mail. -2- In caseof online bookings the confirmation of order reception through electronic mailmay recapitulate the contractual offer, accommodations, and exclusive services,prices, purchase terms concerning a selected invoice, as accepted by the clientat the time of the completion of the booking, the amount of advance payment,information regarding the service after the purchase, the Client’s right toraise a claim/claims, as well as a request of having access to personalinformation of the Client, including his/her bank card information for theadvance payment, where applicable.
-IX-CUSTOMER SERVICE For everyright of the client concerning the relative order or booking, the customerservice is available to clients as wellas from November to August from Monday to Friday, from 09:00 AM to 17:00 PM(Bahamas time) at the following telephone line +1 786 374 2442 ) and at thefollowing electronic mail address reservations@tiamoresorts.com. -X-CANCELLATION OR MODIFICATION OF THE CLIENT’S BOOKING -1-TheClient’s order is completed with the payment of the total rent or thedesignated advance payment of the rent or the confirmation of the reservationby Tiamo resorts. -2- Withoutprejudice to more specific conditions which may apply following a specialagreement between the Client and the Company, in particular because of apreferential price or a package offer, the individual Client who ordered therental of a tourist lodging with a predetermined period of use, while his/herbooking has been confirmed by Tiamo resorts, but did not use the touristaccommodation for all or part of the period for any reason, must compensateTiamo Resorts with the ½ of the agreed price for the period he/she didn’t usethe accommodation. The amount to be paid may be set off with the advancepayment. Tiamo resorts may refrain from exercising its aforementioned right, inits sole discretion. The individual Client mentioned above shall be exemptedfrom the prescribed compensation only if he/she has warned Tiamo Resorts ofhis/her intention not to use the accommodation at least 31 days before. -3- Theterms of sale for the designated price determine how the booking is canceledand/or modified wherever possible. -4- Ifpossible, the cancellation of the reservation can be made directly from thewebsite or the related services of Tiamo Resorts through the relevantorder/application or by e-mail to the designated e-mail address of the companywith the subject “Change / Cancellation of booking » and by stating the detailsof the booking. -5- TiamoResorts shall offer to its Clients the tourist accommodation, for which itaccepted the order. If for any reason this accommodation is not available,Tiamo resorts bears the obligation to ensure the accommodation of the Clients inother tourist accommodation under its property or management or in other hotelsof the same class and region, which will have the same comforts and conditionsof residence, if these exist, or at the best and nearest availableaccommodation in the same region. If, for this purpose, transport costs and anyadditional difference in price are required, these will be borne by Tiamoresorts. -6- TheClient must accept the accommodation booked by himself/herself or through athird party or part thereof unless this is not in accordance with the order.The Client is also obliged to keep the tourist accommodation up to the end ofthe agreed time and is charged otherwise to pay to Tiamo Resorts a compensationcorresponding to the rent of the remaining days of the proportionate amount onthe agreed accommodation price. This applies also in case of no-show of theclient on the date determined, except in cases of force majeure proven bycompelling facts or evidence. -7- If thetourist accommodation is leased for a certain time, Tiamo Resorts is notentitled to terminate the lease prior to the expiration of the agreed time,unless the Client violates this Regulation and other applicable legalprovisions or violates the principles of morality or public order or suffers fromserious disease, which may cause serious discomfort or danger to other clientsand/or staff of Tiamo Resorts. -8- For anyother relevant issue, the provisions of the Bahamas Tourism Organization on theRegulation for the Relations between Hotel Businesses and their Clients apply.
-XI- Stay inleasehold -1- Rentinga tourist lodging or part of it is valid for one day, unless it is differentlyagreed between the client and Tiamo. The rental is mutually renewed for eachfollowing day, as long as Tiamo Resorts, on one hand, does not inform theclient that the rental expires, and the client, on the other hand, does notinform Tiamo Resorts that he/she will not continue the rental. Thisnotification must be done during the previous day, otherwise it is not validfor that day, but for the next one. -2-Inapplication of the existing regulation the client may be asked during his/herarrival, namely in the beginning of the stay, to fill in a bulletin includinghis data (personal information, ID card/passport data etc.). In order to makethe filling in of the bulletin feasible, the client will be asked to bring anID card so that the company can verify his/her data. Likewise, it is probablethat a security deposit will be asked in cash or by credit card, the sum of whichwill be defined by the company unilaterally for covering mainly damages,cleaning, etc. -3- Giventhat in all tourist lodgings belonging to or administered by Tiamo Resorts there is nodistinctive suitable place for keeping any kind of pets, their retention is notallowed in the tourist lodgings. -4- Theclient accepts and commits to using the tourist lodging or the part of thetourist lodging with the appropriate attention. -5- In casethat in the tourist lodging or the part of it which is reserved, more terms ofuse for the tourist lodging, or for some devices or functions are displayed,the client commits to respect all the displayed instructions. In case of notshowing this kind of respect, which equals to violating the current regulationand the law, Tiamo Resorts is obliged to ask the client to check out withoutany charge on its part and has the right to claim anything that complies withthe current regulation and the law. -6- If aWi-Fi service (with or without payment,) which allows clients to have access onthe Internet, is offered in the tourist lodgings, the client commits so thatthe use of the Internet access will not be aimed at using it for purposes ofreproduction or publication of works or objects that are protected by rights ofintellectual property or related rights, unless it constitutes a lawful useaccording to the corresponding provisions. -7- Theclient is obliged to comply with the security policy of the Internet serviceprovider of the property. -8- Uponarriving, the client is obliged to inform the reception if he/she possessesvaluable things or money that he/she wishes to save and secure in a safebelonging to the Tiamo Resorts company. In case he/she wishes to save them inthe safe which is provided inside the villa, then he/she is exclusivelyresponsible for its right use as well as for its content. Tiamo Resorts takes no responsibilityif any asset of the client is lost, as long as it is not informed on theclient’s arrival. -9- It isclearly forbidden to videotape, take photos and reproduce or print by any meansinside and outside the accommodation space with the aim of republishing orproducing a show, film, documentary or any other similar types, unless specialwritten permission is given by the management of the Tiamo Resorts company. -10-Smoking is allowed only in the exterior space. -11- Thereis a schedule of quiet hours for which the client must be informed and he/shemust follow it. -12- Theclients’ and their visitors’ security and behavior are an exclusiveresponsibility of the person who makes the reservation and has his/her name onit. The owner company takes no responsibility for any injury or accident thatmay happen during their stay in the lodging. -13- Theclients are responsible for their lodgings during their stay. They must providefor securing the doors and windows while they are not in the lodging. Any actionor oversight by the clients or their visitors, which may cancel the securitypolicy of the lodgings and lead to loss or damage, is the client’sresponsibility. -14-Thelodging must be professionally cleaned before and after each client’s arrival. -15- Allconsumable supplies (beauty items and toiletries as well as cleaning products)are provided and replaced by our team. -16- Youmust use the devices only for their expected usage. -17- Drugsor illegal activities are not allowed in the lodgings. -18- Thelodging cannot be subleased by the client. -19- Theclients are strictly responsible for using the swimming pool tanks and thechildren must be supervised by them all the time. The company and its personneltake no responsibility in case the swimming pool tanks are badly used by theclients. -20- Theswimming pool tank is cleaned and conserved with the appropriate chemicalsubstances by our personnel for your safety and hygiene. -21- If theclients or their visitors have problems during their stay, they must directlyinform the managers of the Tiamo Resorts. In order to deal with the problem ora client’s potential complaint, he/she must inform us immediately, whilestaying in the lodging. If no complaintis submitted during his/her stay, the client states silently in this way andaccepts that he/she remained satisfied by the lodging and accommodation andhe/she didn’t have any complaint, as well as that everything was according tohis/her reservation and information.
-XII-GUARANTEE The customerbenefits from the contractual guarantee that may be provided to him/her by theservice (accommodation with extra relevant services or accommodation with extrarelevant and complementary or optional services). -
XIII-RESPONSIBILITIES -1- Tiamo Resorts makes the best possible effort so that the photographs, graphicrepresentations and texts illustrate in the most accurate and truthful mannerpossible the provision of accommodation and other services (basic orcomplementary and/or optional); nonetheless, the actual state and conditionsmay display non-substantial variations or changes in relation to thecorresponding illustrations, mainly because of any technical inability todisplay in a fully accurate manner the actual situation or any renovations ormodifications that may have taken place in the respective touristaccommodation, in order to improve their image and functionality.-2- Tiamo Resorts cannot be held responsible for the non-execution or improper executionof the reservation in case of force majeure, due to an act of a third party oran act of the Client, including: non-availability of the Internet, inability toaccess the Website of the Tiamo Resorts, an external (cyber)attack against thesystem, computer viruses, the case that the prepayment was not authorized orexecuted by the Client’s bank etc.-3-Pertaining to the hyperlinks linking to other websites, to which the website orother relevant services of Tiamo Resorts may refer, the latter is exempted fromany responsibility concerning their content or the services suggested thereon. -4- Anybooking or payment that is irregular, non-functional, incomplete or fraudulentfor any reason, results in the cancellation of the Client’s reservation, at theexpense of his/her own, by maintaining the unconditional right for any civil orcriminal proceedings against the latter.
-XIV-CLAIMS-1- Anyclaims relating to the non-execution or improper execution of the provision ofresidential services must be communicated to the Tiamo Resorts within seven (7)days after departure from the tourist accommodation or from the part of theproperty, with a direct request placed to Tiamo Resorts, at the CustomerService address details given above. In particular, in the event of anunreasonable delay in the notification of any request or claim, Tiamo Resortsis entitled to dismiss any such claim as unfounded or unproven or inadmissible,with the prejudice in each case of the parties (Tiamo Resorts and the Client)of their lawful rights and claims. -XV-PRICES-PRICING-1- Theprices which pertain to booking the accommodation and the other relevant or thecomplementary-optional services are referred beforehand and in the context ofthe procedure of ordering the rental. -2- Theprices are per tourist accommodation or part of tourist accommodation for thenumber of persons and the date or the period selected.-3- Theprices fixed for the Client are applicable and always paid in USD $, only forthe period specified on the website or in the other relevant services of TiamoResorts. -4- If thecharge is made on the spot, with conversion in USA Dollars from a differentcurrency, the rate applies at the time of actual payment, and any exchangecosts are always borne by the Client. -5- Withthe exception of a declaration expressly stated on the website and otherrelated services of the Tiamo Resorts or of a contradictory express agreement,the provision of supplementary or optional services is not included in theprice offered. -6- Anytourist tax, detention, fee, charge etc. without exception, where applicable,will constitute part of the final price or will result from the final invoiceissued and will be paid in the time that it applies and when the obligation topay the amount on/to which this is calculated or attributed or withheld orgenerally attributable is due, unless this amount is legally included in theoriginal accommodation price before other indirect or direct taxes,reservations etc.. -7- Theprices on offer always include the corresponding VAT, which applies on the dateof the order. Any change in the applicable VAT coefficient prior to theClient’s departure will be automatically charged upon the agreed price beforeVAT, on the date of invoicing. -8- Anychanges or charges of new taxes made by the competent authorities will beautomatically reflected on the prices indicated in the pricing. -9- Iffollowing the agreement the payment is to be made upon arrival or departurefrom the tourist accommodation and the currency of the customer does notcoincide with that of Tiamo Resorts in The Bahamas (USD), the debit price ofTiamo Resorts may be subject to differentiation from that notified in thecontext of booking, in order to take into account the possible change in theexchange rate or the cost of conversion in USD, which is always borne by thecustomer.-10- TiamoResorts indicates the total cost of the rent/lease and for the correspondingservices during the booking process. -11-Certain promotional offers made available from the Internet, or in general, arelikely to be made available for exclusive sale from the Internet or by theprovider that offers and advertises them and/or exclusively by distance and maynot apply to orders and reservations made on-site.
-XVI-PAYMENT -1- Theclient notifies the data of the bank account connected to his bank, credit ordebit card, as well as the card information, initially for the advance paymentand secondly as a guarantee for any potential claims by Tiamo Resort concerningthe lease of the tourist lodgings and the provision of respective services ordue to the latter. For every payment executed (advance or final payment), whichis done through a bank, credit or debit card (VISA, MASTERCARD, AMERICAN EXPRESS)special terms may be applicable following the respective agreements. The Clientindicates the card’s security credentials (encrypted zone) without any spacesbetween the numbers, as well as the date of expiry and the security code, inthe context of the request of the order’s confirmation. -2- Thecharge of the payment minus the deposit or-if applicable-the total amount dueis made on the spot (in the reception area of the property) at the end of thecustomer’s stay, except in cases of special payment conditions or billing ofpayment in the process of booking (prepayment upon booking). In case of anyprice not being pre-paid in its entirety, Tiamo Resorts is entitled to ask the Client during his/her arrival, an amount for guarantee or permission to chargethe debit or credit card in order to guarantee payment of the amountcorresponding to the services used by the customer on-site or the prepaymentupon arrival of the remaining amount of the reservation according to the specific agreement terms with the customer.-3- If the Client books more tourist lodgings orparts of the property, advance payment is deemed necessary, in principle, toconfirm the reservation; the payment corresponds to only one of thelodgings/parts, but the company reserves the right to request an advance paymentdeposit for the remaining accommodation. The payment card used to pay the advance during the booking process may be used as a guarantee or means ofpayment of the rent and other fees, etc. and in respect of the other touristlodgings or parts of the latter. -4- Uponadvance payment/pre-payment the amount charged in the process of bookingincludes: the cost of accommodation plus the basic services, the taxescorresponding to the stay and the services, as well as any other complementaryor optional service selected by the Client. -5- TiamoResorts may issue e-invoices of value, the original electronically maintainedinvoice may be confirmed and certified under the law and may be accessible byany means, including the Internet, e-mail etc.
-XVII- RESPECT OF PRIVATE LIFE-1- Clientsare informed, in every sheet for the collection of personal information, on theobligatory or optional character of their replies with a notation made with anasterisk or a square or the √ sign. -2- In theabsence of information suggested as obligatory, Tiamo Resorts is entitled notto register and not to accept the order and in general not to proceed with anyrequest made by the Client. -3- Theinformation compiled and processed are exclusively destined for Tiamo Resortsand its associates and solely on grounds of serving the contractual agreementsgoverned by the present Regulation, always according to the principles ofnecessity and proportionality. -4- Theassociates, providers of services may have their registered seat in a thirdcountry, outside The Bahamas. -5- In thecontext of precontractual procedures in view of the booking, Tiamo Resorts mayask from the client his/her identity information, data about his/her personalor professional life, as well as financial information. -6- TheClient empowers Tiamo Resorts to notify his/her personal data to third partiesonly under the condition that such a notification does not contradict theprovisions of public order. -7- Inparticular, in the context of the payment (online or not), the bank details ofthe customer will be transferred and notified by the Tiamo Resorts provider ofthe corresponding service to the Bank of Tiamo Resorts for the execution andimplementation of the contract of Stay. Therefore, the customer is informedthat such data transfer may be carried out in third countries that do not havea system of personal data protection. However, the customer consents to thedata transfer requirement that is necessary for the execution of the contract. TiamoResorts requires the provider to be bound and to guarantee to make the bestpossible effort to maintain the confidentiality of data on such transfers. -8- TheClient reserves the right and any claim thereof and indicatively thediscretionary power and the ability to oppose, without expenses, to the use ofhis/her personal data for commercial or other reasons, the right of oppositionfor any lawful reason, the right to submit questions, the right to have accessand restore by addressing a respective request to Tiamo Resorts andparticularly with an e-mail to the e-mail address indicated above. -9- TiamoResorts reserves the right to put in place a system of management of personaldata, following the law, in order to preserve and ensure the goods and interestsof its Clients, on the first hand, and to deal with cases of non-payment, onthe other. In this context, Tiamo Resorts may keep, a private, secret anddestined for its exclusive use, registry of Clients who have demonstrated animproper behavior as for the following categories: aggressive and improperbehavior, lack of respect of the terms of the present contract, lack of respectof the security rules, mainly as far as the use of swimming pools, which are anen-suite to the touristic residences or to their parts, is concerned, thefts,immoral behavior, vandalism and disobedience to the regulation. Inclusion inthe file mentioned above may result, where appropriate, to the Tiamo Resorts’sdenial, without any specific justification, to proceed to the acceptance of anyorder made by these persons for a period of its choice. This file is not to be,most certainly, disclosed to any third party.
-XVIII-AGREEMENT OF A BINDING CONTRACT -1- Theprovision and reception of bank data, as well as the acceptance of the generalterms of accommodation and of the order form, constitutes an electronicsignature, which between the parties has the same value with a hand-writtensignature. -2- Thedatabank of transactions and communications is maintained in the informationsystem of Tiamo Resorts under reasonable terms of security and is considered areceipt of the content of communications, orders, and payments between TiamoResorts and its Clients. -3-TheClient is informed that his/her IP address is registered in the system whileplacing his/her order.
-XX- FORCEMAJEURE -1- Theforce majeure for the purposes of the present is perceived as an external forall parties event, which is characterized by an unexpected, uncontrollable, andirreversible nature and which impedes the Client or Tiamo Resorts fromfulfilling all or part of their stipulated obligations. The cases of forcemajeure recognized by judicial jurisprudence in Greece are, by definition,being accepted and perceived as such incidents of force majeure. -2- None ofthe parties may be considered responsible about the other in case ofnon-implementation of the obligations deriving from such an event caused byforce majeure, with the reservation of any special terms set in the presentregulation or set out in the law.
-XXI-SETTLEMENT OF DISPUTES The clientis informed by the Tiamo Resorts for the possibility of bringing an action incase of a dispute regarding the present terms, in the process of amicable orconventional reconciliation, or with any other alternative means ofextrajudicial settlement of the dispute.
-XXII-APPLICABLE LAW The presentterms of stay are governed by Greek law, and any potential dispute between theclient and the Company is subject to the exclusive competence of the competentjudicial authorities of the Courts of The Bahamas.-XXIII-TOTAL/TOTALITY OF TERMS -1- Thepresent terms of accommodation-provision of services and the respective legalprovisions, express the totality of the obligations and rights of Tiamo Resortsand the Clients, with the reservation of more specific terms having been agreedwith a newer written contract between the Client and the Company. -2- TheClient may not require that Tiamo Resorts incorporate in these terms any otherrequest or special term unless this constitutes the content of a compulsorylegal provision, which may not be explicitly included in the presentregulation. -3- Τhedocuments that prove the binding commitments by Tiamo Resorts and the Clientand, in particular, the order request, the request for the confirmation of theorder, the acceptance of the order-confirmation of booking, and the respectiveissued invoices. -4- Ιn caseof a possible contradiction between the documents proving the reservation andits content and the present terms of accommodation, the potential more specificagreements of each given reservation prevail.
-XXIV- MODIFICATION OF THE PRESENT REGULATION The presentRegulation may be modified or/and updated by Tiamo Resorts at any time. In thatcase, the new version which is to be uploaded online by Tiamo Resorts, willapply to all Clients without delay.
